EUGENE, ORE: Oregon Supreme Court overturns child pornography conviction of Randall D. Simons, JonBenét Ramsey photographer, after creating a new privacy ruling/precedent that nullified crucial evidence used to convict him of 15 counts of first-degree encouraging child sexual abuse.

Without those key pieces of evidence, the Lane County District Attorney's Office has dismissed the child pornography conviction of JonBenét Ramsey photographer.

Caught Using "Free" WiFi to Access Child Porn

In July 2018, an Oregon restaurant Wi-Fi operator noticed that their public Wi-Fi router was showing that a device had accessed internet content tagged as child abuse images. They contacted the police as they should, and the investigation began.

The investigation found that Randall DeWitt Simons repeatedly used a free public wi-fi network at a local restaurant to access child pornography between 2018 and 2019, according to the district attorney's office. Randall DeWitt Simons was later convicted of 15 counts of first-degree encouraging child sexual abuse in 2019 and sentenced to 10 years in prison.

Earlier this year in April 2026, the Oregon Supreme Court officially overturned and dismissed the case against the JonBenét Ramsey photographer, Randall Simons, and threw out his 2019 conviction.

The Oregon State Supreme Court ruled that police violated privacy rights under the Oregon Constitution by gathering internet history at public restaurant without a warrant, even after Simons had agreed to the Terms and Conditions of use for the public WiFi network.

Ultimately, the state supreme court ruled that police violated privacy rights under the Oregon Constitution by monitoring his internet history without a warrant, regardless of the fact it was public WiFi paid for by the business who initially call the police to report Randall Simons illegal activity.

Unfortunately, without those key pieces of evidence, the prosecutors called the case ‘fatally compromised’ after that, and they dismissed all charges.

In December 2025, Fox 12 Oregon reported via DENVER (KUSA) that Colorado investigators still have the Ramsey cold case as a top priority for the department.

Conclusion

In this Landmark decision, wherein, Justice James held that… “The court rejected the state’s argument that Simons had no reasonable expectation of privacy because he connected to the A&W network after clicking through terms-of-service notices warning that the business might monitor traffic and cooperate with law enforcement." Oregon business owners are left wondering if they have any rights left at all.

The Oregon Supreme Court and Justice James is so disconnected that they fail to see the ramifications of disregarding business Terms & Condition. This pertains to all Terms and Conditions, and not just online, because the person was actually at the location, physically there using their equipment to view child pornography after signing the T&C with full knowledge of possible monitoring.

If a business cannot report criminal activity happening at their place of business, we have a serious problem.

Child pornography cases are serious offences, and should not be taken lightly. However, it seems that Oregon and many other progressive states are rushing to release as predators, lower age of consent, and some leftists are even trying to normalize pedophile by calling them Minor Attracted Person (MAPs).
